Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.

In her decision, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal challenge center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in Tennessee.

Terms of Release

The judge, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
